01Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Christopher Martinez, doing business as Content By Lens ("we," "us" or "our"), concerning your access to and use of the contentbylens.com website.
By accessing the Site or engaging our services, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions.
02Services Provided
Content By Lens provides video production and direct-response advertising services for businesses, including on-site filming, video editing, ad campaign setup and management, landing pages, and automated lead follow-up.
03Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site are owned or controlled by us and are protected by copyright and trademark laws.
04User Representations
By using the Site or our services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; and (2) you have the legal capacity and you agree to comply with these Terms and Conditions.
05Limitation of Liability
To the fullest extent permitted by law, in no event will we be liable to you for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data arising from your use of the Site or our services.
06Governing Law
These Terms shall be governed by and defined following the laws of the State of California. Christopher Martinez and yourself irrevocably consent that the courts of the State of California shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
07SMS/Mobile Messaging Terms & Conditions
By consenting to Content By Lens’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of us through your wireless provider to the mobile number you provided. Consent is not a condition of purchase.
- Program Description: We send text messages to confirm and remind you about appointments, follow up on your inquiry, and share project updates.
- Message Frequency: Message frequency varies.
- Opt-Out: You can cancel the SMS service at any time. Just reply "STOP" to any message you receive from us, or text "STOP" to 619-333-7071. After you send "STOP," we will send you one SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
- Help: If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or get help directly at [email protected].
- Carriers: Carriers are not liable for delayed or undelivered messages.
- Rates: Message and data rates may apply for any messages sent to you from us and to us from you.
